PREAMBLE

These terms and conditions of sale are entered into on the one hand by the company Flotte, SAS with capital of €1,000, whose registered office is at 22 boulevard Voltaire 75011 Paris, registered in the Paris Trade and Companies Register under no. 889 416 483, hereinafter referred to as "FLOTTE", and on the other hand by any individual or legal entity wishing to make a purchase via the website www.flotte.fr , hereinafter referred to as "the Customer"

FLOTTE reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The General Terms and Conditions of Sale applicable are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Terms and Conditions of Sale in force at the time the order is placed.

The purpose of these General Terms and Conditions of Sale is to define the rules applicable to the sale of FLOTTE-branded products on the Site, by any individual of legal age or minor with parental authorization, who is not a merchant, has the legal capacity to enter into a contract, and is domiciled exclusively in the countries supplied by www.flotte.fr, and who purchases a Product from the Site.


ARTICLE 1 - PURPOSE

The purpose of the General Terms and Conditions herein is to define the terms and conditions according to which Products are sold by FLOTTE to its Customers. They regulate the various stages of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.


ARTICLE 2 - PRODUCTS

The Products offered for sale by FLOTTE are those listed on the Site on the day of consultation by the Customer. Each Product will be the subject of a description sheet which, in addition to the photograph, will contain: the price, the photograph, the sizes and colors available, the composition, as well as any special characteristics. Minor differences between a product and its photograph may exist, depending in particular on the resolution and color definition of the user's screen.

FLOTTE undertakes to deliver, within the limits of available stocks, Products that comply with current regulations relating to the health and safety of persons in accordance with European provisions, and in particular with legislation on regulated chemical substances.

Information on product availability is provided at the time the order is placed. In the event of product unavailability after the order has been placed, FLOTTE undertakes to inform the customer by e-mail as soon as possible after receipt of the information. The order for this product will be automatically cancelled, the rest of the order remaining firm and definitive.

Reimbursement will be made directly to the customer's bank account no later than fourteen days after payment of the sums paid by the customer

ARTICLE 3 - PRICES

Prices are indicated in Euros all taxes included. taxes included, excluding delivery charges; it being specified that the value-added tax is that in force in metropolitan France on the day the order is validated.

The prices applied are those communicated on the Site, are guaranteed within the limits of available stocks and are confirmed to the Customer when the order is validated.

Delivery costs are communicated to the Customer on the order summary page before the order is validated, and are inclusive of all taxes. These costs are payable by the Customer and are invoiced in addition to the sale price of the Products.

The transfer of the risks of loss and deterioration of the Products will take place after delivery and receipt of the Products by the Customer.

We reserve the right to modify our prices at any time, but we undertake to apply the prices indicated on the Site at the time of your order.

We inform you that in the event of the display of an erroneous or obviously derisory price (low price), for whatever reason (computer bug, manual error, technical error, etc.), the order - even if validated by us - will be cancelled, and we will inform you of this as soon as possible. You will then be able, if you wish, to place your order again at the correct price.

For deliveries abroad, the recipient may be required to pay delivery and customs charges, depending on the legislation in force in the country of destination.

ARTICLE 4 - ORDERING AND PAYMENT

- 4.1 PLACING AN ORDER

The Customer places an order by completing the following 5 steps

Step 1: For the first order, the customer must create a customer account by filling in a form containing the following information: title, surname, first name, full delivery address, e-mail and telephone number. The customer then specifies the delivery method chosen. The customer must then identify him/herself by entering his/her e-mail address and password. The customer is informed and accepts that entering these two identifiers (e-mail address and password) constitutes proof of identity and expresses consent. The customer declares that he/she is 18 years of age or, failing this, that he/she has parental authorization to place an order on the site.

Step 2: The customer selects the chosen Products and adds them to his/her shopping cart after selecting the size and color desired.

At any time, the customer may:

  • Obtain a summary of the products selected by clicking on the link at the top right of the "My basket" screen, indicating the number of Products it contains.

  • Continue shopping by clicking on the "Continue shopping" link.

  • Complete your selection and place your order by clicking on the "Checkout" link.

Step 3: The customer checks the contents of the shopping basket by clicking on "Checkout" to access the order summary. The customer can then modify his/her order (product, size, quantity).

The total amount of the order, including VAT, distinguishing between the price due for the Products on the one hand, and the delivery charges on the other, is then indicated in the "Order summary" box. summary. Once the order has been checked and, if necessary, modified, the Customer validates his basket in order to finalize his order by clicking again on "order".

If the Customer has an advantage code, he/she must enter it in the space provided in order to benefit from it.

Step 4: Customer enters delivery and billing details

With the exception of the date of birth, additional address and delivery information, all fields are required to finalize the order. Unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.

If the Customer has already placed an order on the Site, he/she will have a customer account. In this case, he/she will only identify himself/herself with his/her e-mail address and password.

The customer then checks all the information and clicks on "validate" to continue with the order.

Step 5: Entering bank details

The Customer will then access the secure payment screen of our partner FLOTTE, as specified in article 4.3 below.

Payment is made online by credit card only.

The Customer must enter his/her credit card number, its date of validity and the 3 digits of the visual cryptogram on the back of the card. In the case of payment by American Express, the Customer must enter 4 digits.

If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

If payment fails, the Customer will have up to 3 attempts to re-enter his/her bank details. After the 3rd refusal, the Customer will be redirected to a screen on the Site indicating that payment has been refused. The Customer will then be invited to contact FLOTTE customer service to find out the reasons for the refusal, and to work together to find a solution to finalize the Customer's order.

- 4.2 ORDER CONFIRMATION

As soon as the Customer's payment has been accepted, the Customer will receive an e-mail confirming the order, summarizing all the items ordered, the billing and delivery address and the delivery date.

Validation of the order by the Customer and the order confirmation sent to the Customer by e-mail by FLOTTE following acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Terms and Conditions of Sale.

Customers who have placed an order may print their invoice by logging on to the Site in the order tracking area provided for this purpose.

FLOTTE reserves the right not to validate the order in the event of :

  • Abnormal or abusive complaints,

  • abnormal orders with regard to quantities ordered,

  • abnormal or abusive exchanges and returns,

  • existing dispute(s) with the customer.

We reserve the right to refuse an order for a legitimate reason, for example in the following circumstances:

  • The item ordered is no longer in stock;

  • We were unable to obtain payment authorization;

  • An error has been identified in the product information, including price or promotion; and/or

  • If we suspect fraudulent activity.

In all cases we will inform you accordingly, and if payment for your order has already been made, we will refund you without delay and in any event within 14 days.

For all orders over 120 € FLOTTE may request proof of identity before preparing and dispatching the order.

- 4.3 PAYMENT

The price of the Products purchased is payable in cash, in full, on the day the order is placed by the Customer. Payment is made online by the following methods (Carte Bleue, Visa, Mastercard, Paypal, Scalapay) at the time the order is validated by the Customer.

Our partner Scalapay offers three-installment payment (currently unavailable for Monegasque Internet users), free of charge, for all orders over 150 euros. Partial payments by gift card are not available with this payment solution.

Payment by Scalapay: is made online when the order is placed. It is secured by Scalapay and allows you to make your purchases in complete safety. Payment is made in three instalments: 1st instalment at the time of purchase, 2nd instalment 1 month after the day of purchase, 3rd instalment 2 months after the day of purchase.

If the Internet user chooses to pay in three instalments without charge, he/she must accept the terms and conditions of use, or the general terms and conditions of sale, as well as the privacy policy of SCALAPAY, which will then become his/her sole contact for any questions or requests relating to this payment solution. The Internet User must take all necessary steps to obtain any information on this payment method, in order to assess it in the light of his or her own repayment capacity and thus avoid any risk of over-indebtedness.

Authorization to debit the card is requested when the order is validated on the Site, except in the event of server unavailability. FLOTTE reserves the right to make a new direct debit authorization request if the first request is unsuccessful due to server unavailability.

In the event of non-payment, incorrect address or any other problem with the Customer's account, FLOTTE reserves the right to block the Customer's order until the problem has been resolved.

In the event of fraudulent use of the Customer's credit card on the Site, the Customer is invited to contact FLOTTE via chat or e-mail: hello@flotte.fr

All information exchanged to process payment is encrypted using SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time does the customer's financial data pass through the FLOTTE computer system. Stripe verifies that the connection with the customer's browser is secure before sending the payment form to the banking institution carrying out the financial transaction.

As Stripe is a technical service provider, it does not handle any disputes relating to orders, which are handled directly by FLOTTE as specified above or, where applicable, by the Customer's bank.

- 4.4 ORDER ARCHIVING

The order confirmation is recorded on FLOTTE's registers, which are themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

ARTICLE 5 - DELIVERY

Delivery time :

All orders confirmed on the site are in no way binding. Orders placed from Monday to Thursday will be processed the same day; after 3 p.m., they will be processed the following day. Orders placed on Fridays, Saturdays and Sundays will be processed on Mondays or Tuesdays (depending on the carrier); orders placed on public holidays will be processed on the next working day.

If the delivery time is exceeded, without justification by a case of force majeure, the Customer may request the cancellation of the sale and obtain a refund of the sums paid for the salewithin a maximum period of 14 days

We endeavour to deliver orders within 10 working days for delivery to Metropolitan France, and 20 working days for delivery to any other destination, from the day following payment of the order.

However, during busy periods, deliveries may take longer. We remind you that Saturdays and Sundays are not counted as working days. If your order has not arrived within ten working days, please contact our Customer Service:

Please also note that no change of delivery address can be made after your order has been placed.

FLOTTE reserves the right to refuse to deliver orders from private individuals to collective addresses such as offices, nursing homes or residential establishments. In the event of delivery to a collective address, the customer acknowledges that FLOTTE's obligation to deliver the order ends with the actual delivery to the collective address indicated on the order form, even if the shipment is not received by the final recipient but by a third party.

For orders outside France, when the parcel intended for export reaches its destination, it is the recipient's responsibility to pay any taxes or customs duties applicable in the country of destination. Local authorities can provide useful information.

ARTICLE 6 - RECEIPT OF ORDER - COMPLAINTS - RETURNS

We do our best to ensure that all our products meet the high quality standards that our customers expect. However, despite the great care we take in processing orders, some products may slip through our checks and inspections. This is why, upon receipt of the order, the customer is obliged to check the conformity of the Products received in fulfilment of the order at the time of delivery.

In the event of a damaged parcel, we ask you not to accept a damaged parcel (packaging with visible traces of opening and/or deterioration): it must be refused. Packages leaving the onparledevous.fr warehouses are always in perfect condition, and must be delivered to you in this state. If no reservations are made, we will not be able to take account of any missing items, nor will we be able to pay any compensation.

Any anomaly concerning the delivery such as :

  • missing products,

  • damaged products,

  • products not conforming to the order, must be notified to our Customer Service Department on the day of receipt, or no later than 3 days after receipt:

Please include as many details as possible about the order and the problem encountered with the products concerned.

After this period, and except for hidden defects, no claim will be accepted by FLOTTE, the Products then being deemed to be in conformity, and FLOTTE will be released from all liability.

FLOTTE reserves the right to ask the customer to return the defective product. If the aforementioned conditions are met, FLOTTE will then exchange the defective product(s), issue a credit note, reimburse the defective product(s), or reship the missing product (subject to the validity of the buyer's request).

For all returns of non-conforming products, the customer must comply with the following procedure:

  • The customer must complete the returns form available on the site under the heading "Exchanges & returns".

  • You will receive an e-mail validation including a return confirmation with the return form that the customer must enclose with his parcel. No return will be accepted without the duly completed return form.

  • Products must be returned in their original packaging in perfect condition for resale (shoe box, plastic pouches, etc.), with their label and any accessories, in perfect condition to : E-boutique FLOTTE - 22, boulevard Voltaire - 75011 Paris. Returns of washed and/or worn garments, as well as damaged boxes, will be refused.

  • For all returns, please keep your shipping receipts. Make sure your return is well packaged to avoid damage to products or boxes.

Once the non-conformity has been established, FLOTTE will offer the Customer either :

  • replacement of the Product(s) at FLOTTE's expense, or

  • reimbursement of the price of the order (price of the Products), at the latest within thirty (30) days from the date of receipt of the non-conforming Product(s) by FLOTTE's customer service department.

In the event of a refund, FLOTTE will reimburse all Products returned in conformity, with the exception of taxes and customs duties paid by the customer at the time of delivery.

In the event of abnormal or abusive complaints, FLOTTE may refuse to serve a subsequent order.

Our products are covered by legal guarantees, i.e. the legal guarantee of conformity and the guarantee against hidden defects. In our capacity as seller, we are effectively liable:
  1. defects in conformity of the products you purchase, under the conditions of article L.217-4 et seq. of the French Consumer Code. The legal guarantee of conformity applies when your product presents a defect of conformity, for example when your product does not function in accordance with the uses to which it is usually put, or when it does not correspond to the description given;

  2. and hidden defects under the terms of article 1641 et seq. of the French Civil Code. The warranty for hidden defects covers you when your product has a hidden defect, i.e. a defect that is not apparent at the time of sale, which renders the product unfit for its intended use, or which significantly diminishes that use.

Please note that the legal warranty of conformity and the warranty for hidden defects will not be applicable in the event of misuse of your products or failure to respect the maintenance conditions for your product (provided on our labels or by our retouchers).

If you make a claim under the legal warranty of conformity, you :

  • - have a period of two (2) years from the date of delivery of the product to take action;

  • - may choose between repairing or replacing the product, subject to the cost conditions set out in article L.217-9 of the French Consumer Code;

  • - are exempt from having to prove the existence of a lack of conformity for a period of twenty-four (24) months following delivery of the product, except for second-hand goods for which the period is twelve (12) months.

The legal warranty of conformity applies independently of any commercial warranty.

You may decide to invoke the warranty for latent defects under article 1641 of the French Civil Code. In this case, you may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.


ARTICLE 7 - RIGHT OF WITHDRAWAL

Only orders placed on www.flotte.fr may be returned or exchanged by FLOTTE. The Customer has a period of 14 working days from the date of receipt of the order to return the Products ordered, without justification or penalty.

For any exchange or return under the provisions of articles L 121-16, the procedure below must be followed in full:

  • The customer must complete the returns form available on the site under the heading "Exchanges & returns".

  • You will receive an e-mail with a confirmation of the return and a returns form, which the customer must enclose with the parcel. No return will be accepted without the returns form duly completed.

  • Products must be returned in their original packaging in perfect condition for resale (shoe box, plastic pouches, etc.), with their label and any accessories, in perfect condition to : E-boutique FLOTTE - 22, boulevard Voltaire - 75011 Paris. Returns of washed and/or worn garments, as well as damaged boxes, will be refused.

  • For all returns, please keep your shipping receipts. Make sure your return is well packaged to avoid any damage to products or boxes.

  • All purchases made in Flotte boutiques can be exchanged or returned for a voucher. No refunds are possible.

  • Purchases made on the Flotte website cannot be exchanged or returned to the Flotte boutique.

  • The lifetime gift card is non-refundable.

Subject to the above conditions, FLOTTE will reimburse the Customer for the amount of the order including VAT. Return shipping costs are invoiced in the event of a final return and are automatically deducted from the refund. The Customer's bank account will be credited with the said amount, within 14 days of receipt of the Products by FLOTTE.

You may also notify us of the exercise of your right of withdrawal within 14 days of receipt of your order by using the withdrawal form available here.

ARTICLE 8 - LOYALTY PROGRAM

General terms and conditions of sale for Flotte's "Le Flotte Club" loyalty program:

1. Membership of the Loyalty Program

The Flotte Loyalty Program called "Le Flotte Club" is based on a points system where each euro spent equals one point. To join the Club and benefit from its advantages, customers must create an account on our website or in a Flotte store.

2. Points acquisition and Loyalty Levels

  • To join the Flotte loyalty program, customers must create an account on the website or in a Flotte boutique. For in-store purchases, please provide your e-mail address at checkout to collect points and benefit from the advantages of the Loyalty Program.
  • Every euro spent equals one loyalty point. Members earn loyalty points with every purchase made on the website or in a Flotte boutique.
  • Members reach member status automatically as soon as they accumulate 150 points, equivalent to €150 spent, on the e-shop or in Flotte boutiques.
  • Points accumulated can be used to obtain exclusive rewards according to the tiers defined below.


3. Loyalty levels and associated benefits

  • Bronze (between 150-299 points): Members benefit from a 15% discount valid on the next order placed on the Site or in a Flotte boutique, and in accordance with the provisions of the "Prices" article herein (with the application of shipping costs under the conditions of the "Shipping costs" article) and early access to new collections and exclusive sales.
  • Silver (300-599 points): Members receive a free cap (worth €40) on purchases of €150 or more (with shipping costs applied as per the "Shipping costs" article) on their next order placed on theSite or in a Flotte boutique, access to Flotte Experience competitions and benefits from partner brands.
  • Gold (between 600-1199 points): Members benefit from a 20% discount valid on the next order placed on the Site or in a Flotte boutique, and in accordance with the provisions of the "Price" article herein; with the application of shipping costs under the conditions of the "Shipping costs" article,), a private session with a personal shopper in the boutique, and have the possibility of privatizing the boutique for a private event.
  • Platinum (1200 points or more): Members benefit from a 10% discount on all orders placed on the Site or in the Flotte boutique, and in accordance with the provisions of the "Prices" article herein (with the application of shipping costs under the conditions of the "Shipping costs" article), free express delivery for life, a free Flotte T-shirt valid on the next order (with the application of shipping costs under the conditions of the "Shipping costs" article), a meeting with the founders, and access to prototype sales.


4. Awarding Points and Rewards

  • Accumulated points, rewards and corresponding codes will be sent automatically by email within 20 days of the order date.
  • Codes are not cumulative.
  • Codes are valid for a single use and are valid for 12 months (with the exception of lifetime rewards for the Platinum level).


5. Waiting Period for Accumulated Points

In the event of a refund for one or more items within 20 days of the purchase date, accumulated points will be put on hold and adjusted accordingly.

6. Validity of Status and Points

Loyalty status and points accumulated under the Fleet Loyalty Program are valid for life from the date of acquisition. It is important to note that this policy applies to all loyalty levels. Only rewards expire after 12 months, if they have not been used since they were awarded (with the exception of rewards offered by lifetime for Platinum level).

7. Acceptance of Terms

  • Fleet reserves the right to modify, suspend or cancel the Loyalty Program at any time without notice.
  • Fleet reserves the right to cancel a member's account in the event of abuse or fraud.
  • Loyalty program discounts and benefits cannot be exchanged for cash or transferred to others.
  • Loyalty program members must comply with Fleet's general terms and conditions of sale, available on the website.


By joining the Flotte loyalty program, members accept these terms and conditions without reservation.

ARTICLE 9 - PERSONAL DATA

FLOTTE collects a certain amount of information necessary to process orders.

This data is not only necessary for FLOTTE to process the Customer's order, but also to provide the Customer with information on the FLOTTE brand, on the Site or to enable the Customer to benefit from FLOTTE's commercial offers; if the Customer accepts by validating his order.

This information is strictly confidential and is marked with an asterisk (*) when it is necessary for FLOTTE and/or its service providers to manage the Customer's order.

Following any injunction from the legal authorities or in order to defend its rights or those of its employees, customers or any other person, FLOTTE may communicate this data to legally authorized organizations and authorities.

FLOTTE undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer's personal information from being distorted, damaged or accessed by unauthorized third parties.

The Customer's personal information is sent to and stored at the site's host located in France, whose contact details appear on the site under the heading "Legal Information".

In accordance with the French Data Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, customers have the right to access, rectify, modify and delete data concerning them.

The site is registered with the Commission Nationale de l'Informatique et des Libertés (CNIL) under no. 1351361. In accordance with article L.223-2 of the French Consumer Code, the Customer is informed that he/she has the right to register, free of charge, on the list of opposition to telephone canvassing managed by Opposetel (Bloctel service).

By registering, you will no longer be contacted by telephone by a professional with whom the Customer has no current contractual relationship.

ARTICLE 10 - INTELLECTUAL PROPERTY

All elements of the site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

They are the exclusive property of FLOTTE. Users who have a personal website and wish to place a simple link on their site for personal use, referring directly to the site's homepage, must request authorization from FLOTTE.

However, any hypertext link to the site using framing or in-line linking techniques is strictly prohibited.

In all cases, any link, even if tacitly authorized, must be removed on simple request by FLOTTE.
Hypertext links may lead to sites other than the site. FLOTTE declines all responsibility in the event that the content of these sites contravenes the laws and regulations in force.

ARTICLE 11 - COOKIES

In order to process the Customer's order, and in order to better understand the Customer's needs and personalize the services offered on the Site, FLOTTE uses cookies. A cookie is a computer file stored on the hard disk of the Customer's computer, the purpose of which is to indicate that the Customer has visited the Site.

Cookies memorize the time customers spend on the Site, their identity (known through their e-mail address and password) and the contents of their shopping cart. Once disconnected from the Site, this information is stored for 30 days before being permanently deleted.

Customers may prevent cookies from being saved by configuring their Internet browser. In this case, he/she will not be able to personalize the service offered on the Site.

ARTICLE 12 - LIMITATION OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, particularly with regard to technical performance, response times, connection times, queries or transfers of information, risks of interruption, risks of contamination by viruses circulating on the network and, in general, all risks associated with the use of the Internet network.

FLOTTE may not be held liable for any direct or indirect damage resulting from misuse or incident related to the use of the computer, Internet access, maintenance or malfunction of the servers, telephone line or any other technical connection, as the Customer's connection to the Site is under his or her sole responsibility.

ARTICLE 13 - FORCE MAJEURE

FLOTTE shall not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if such non-performance is caused by an event constituting force majeure as defined by positive law.

In such a case, FLOTTE will inform the Customer of the occurrence of such an event within 3 clear days of its occurrence, by post.

After a period of 1 month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and, where applicable, a refund will be made to the FLOTTE credit card used to place the order within a maximum period of 30 days.

ARTICLE 14 - APPLICABLE LAW

Should any of the terms of these General Terms and Conditions of Sale be declared null and void, illegal or unenforceable by a court decision, the other provisions of the General Terms and Conditions of Sale shall remain in force.

The General Terms and Conditions of Sale are executed and interpreted in accordance with French law.

In the event of dispute, the customer shall first contact FLOTTE to obtain an amicable solution. Failing agreement, the Tribunal de Commerce de Paris shall have sole jurisdiction.



ARTICLE 15 - MEDIATION

We do not wish it, but it may happen that we disagree!

Please note that our General Terms and Conditions of Sale are governed by French law, and that your orders are subject to the General Terms and Conditions of Sale in force on the day of your order.

Please note that any request for mediation must state the subject of the dispute and the documents in the file, so that it can be processed as quickly as possible.

If we are unable to reach an amicable solution, the French courts will have jurisdiction and French law will apply.
